Women NOT Availing Company Transport

As per the labour law, we are mandated to arrange a safe drop for all women employees who works after 8 pm in BPO / IT sector. What if a women employee is availing their own transport? Will the company be responsible if something happens to them? Is there any law which can be shared to management to make a process around this. We came to know many corporate"s take a self declaration from such female employees who opt out of company provided transport and use their personal mode of transport.It would be great of anyone from the group can share any link related to this rule and some format on which they take the declaration.ThanksParas Kumar

This is not a new problem and I experienced this as early as 2003 while working at Wipro Spectramind. We used to take a declaration from the employee that the organisation has offered them transportation however they are voluntarily making their own arrangement for transportation after 8pm and will not hold the company liable in case of any untoward incident outside the premises.. This was equally applicable to lady agents, managers and VP"s.

Declaration can be taken from female employees that even though company provides cab transportation during night hours to their female employees as per mandated law, they have voluntarily opted out of using company provided transportation facility. In case there is any internal Transport Management Tool the Opt out option and self declaration from female employees can be taken via tool itself and automailer can be triggered to employee, primary supervisor and HR SPOC for future records and reference.

Would be great if someone can share the law copy or any link on my official id i.e. paras.kumar1@thesmartcube.com Also, if someone is practising the rule and getting declaration filled, they can share the format of declaration. Would be very helpful.

Hi Paras There is no rule as such however a comony can design their own format and take the undertaking from female associates that she is opting her own transport mode. We deed this in my last organisationVijay

If there is any production of food done in the premises of the Organization be it a Tea or an Egg Boil where you are turning a raw material bought from market to an edible product FSSAI is required. It may be in the name of the organization or in the name of the Caterer who has a direct contract with the organisation.
